Agreement to these terms

These Terms and Conditions govern your use of djaedkreyollite.com and any purchase you make from it. The site is operated by DJAED KREYOL LLC, trading as Djaed Kreyol Lite (“we”, “us”, “our”).

By browsing the site or placing an order, you agree to these terms. If you do not agree with them, please do not use the site.

Our Privacy Policy forms part of these terms.

Who can order

You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. By ordering you confirm that the details you give us are accurate and that you are authorised to use the payment method you provide.

We may refuse or cancel any order, and we may limit quantities per customer or per household, particularly where we suspect fraud or resale.

Products and availability

Everything we sell is hand poured in small batches. That means small differences between jars are normal and are not defects:

• Slight variation in colour, scent strength and the surface of the wax
• Small bubbles, frosting or an uneven top on natural coconut wax
• Minor differences between a product photo and the item you receive

Because batches are small, scents sell out and may be unavailable while the next batch cures. We do not guarantee that any product will remain available, and we may change or discontinue a product at any time.

Burn times, fragrance descriptions and coverage estimates are guidance based on our own testing, not guarantees. Results vary with room size, airflow and how the product is used.

Pricing and payment

Prices are shown in US dollars and exclude tax and shipping unless stated. Sales tax is calculated at checkout where it applies.

We may change prices at any time. The price that applies to your order is the one displayed when you complete checkout.

Payment is taken at the time you place the order. Card details are handled by our payment processor; we never see or store your full card number.

If a product is listed at an incorrect price because of a typing or system error, we may cancel the order and refund you in full, even after you receive a confirmation email.

Orders, changes and cancellations

An order confirmation email means we received your order — it is not acceptance. The contract is formed when we ship the order.

Because we pack quickly, changes and cancellations are only possible before the order ships. Email [email protected] as soon as possible with your order number and we will do what we can.

Fill in: state the exact cancellation window — for example “within 12 hours of ordering” — so customers know where the line is.

Shipping and delivery

Orders are packed within one to two business days. Delivery times given at checkout are carrier estimates, not guarantees, and we are not responsible for carrier delays, weather or customs holds.

Risk of loss passes to you when the carrier takes possession of the package. If a package is marked delivered but you cannot find it, contact the carrier first, then write to us and we will help.

You are responsible for entering a correct and complete shipping address. Packages returned to us because of an incorrect address may be reshipped at your cost.

Fill in: name the regions you ship to, your shipping rates or free-shipping threshold, and whether the customer pays any import duties on international orders.

Candle safety and product use

Candles are an open flame. Read and follow the warning label on every product. In particular:

• Never leave a burning candle unattended, and keep it away from children, pets and anything that can catch fire
• Burn on a heat-resistant, level surface, away from drafts
• Trim the wick to a quarter inch before every burn
• Do not burn for more than four hours at a time, and stop when half an inch of wax remains
• Never move or handle a jar while it is lit or while the wax is molten

Room and body sprays are for external use only. Keep them away from the eyes, and test a small patch of skin first if your skin is sensitive. Discontinue use if irritation occurs.

Car diffusers should be hung so they cannot swing into the driver, block any view, or contact painted or plastic surfaces — fragrance oil can damage those finishes.

You assume all risk arising from failure to follow these instructions and the product warning labels.

Our intellectual property

The site and everything on it — the Djaed Kreyol Lite name, our logo and label artwork, photographs, product descriptions, page copy and design — belongs to DJAED KREYOL LLC or our licensors and is protected by copyright and trademark law.

You may view and share the site for personal, non-commercial use. You may not copy, reproduce, resell or use our content, images or branding for any commercial purpose without our written permission.

Reviews and content you submit

If you post a review, photo, comment or other content, you keep ownership of it. You grant us a non-exclusive, worldwide, royalty-free licence to use, display and share that content in connection with our business, including in marketing.

You confirm that the content is yours to share and does not infringe anyone else's rights. We may remove any content that is unlawful, abusive, misleading or off-topic.

Acceptable use

You agree not to:

• Use the site for any unlawful purpose or in breach of these terms
• Attempt to gain unauthorised access to the site, our systems or another user's account
• Interfere with the site's operation, or introduce viruses or harmful code
• Scrape, harvest or copy content or customer data from the site
• Resell our products as your own or misrepresent your relationship with us

We may suspend or terminate your access for any breach of these terms.

Links to other sites

Our pages may link to sites we do not control, such as social media, payment providers and carrier tracking. We are not responsible for their content, terms or practices. Visiting them is at your own risk.

Disclaimers

The site and our products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the site will be uninterrupted or error free, or that descriptions, pricing or other content are complete or current.

Nothing in these terms excludes any liability that cannot lawfully be excluded, including liability for death or personal injury caused by our negligence.

Limitation of liability

To the fullest extent permitted by law, DJAED KREYOL LLC and its owners, employees and suppliers are not liable for any indirect, incidental, special or consequential damages arising from your use of the site or our products, including lost profits or property damage.

Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

This limitation does not apply to liability arising from our own gross negligence or wilful misconduct, or where the law does not allow such a limit.

Indemnification

You agree to indemnify and hold harmless DJAED KREYOL LLC, its owners and employees from any claim, loss or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of a product, or your violation of any law or third-party right.

Governing law and disputes

These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law rules.

Any dispute that cannot be resolved between us will be brought in the state or federal courts located in New Jersey, and you consent to the jurisdiction of those courts.

Decide with your lawyer: whether to add a binding arbitration clause and a class-action waiver instead of court jurisdiction. This is a significant choice and should not be copied from another store's terms.

Changes to these terms

We may update these terms as our business or the law changes. The version posted on this page at the time you place an order is the version that applies to that order. When we make changes we update the date at the top of this page, and continued use of the site means you accept the revised terms.

Severability and entire agreement

If any part of these terms is found unenforceable, that part will be limited or removed and the rest will stay in force. Our failure to enforce any provision is not a waiver of it.

These terms, together with our Privacy Policy and any policy referenced at checkout, are the entire agreement between you and us regarding the site and your order.
